The leader of Cambodia’s main opposition party, Kem Sokha, was released on bail on Monday, a government spokesman said, a year after he was jailed on treason charges.

“He was released on bail and he is under monitoring by the court,” government spokesman Phay Siphan told Reuters.

Kem Sokha’s daughter, Kem Monovithya, said her 65-year-old father has been placed under house arrest and was in poor health and needed medical attention.

“He has high blood sugar and he needs a long overdue surgery on his left shoulder,” she said.

UN High Commissioner for Human Rights Zeid Ra’ad Al Hussein on Friday warmly welcomed the UN General Assembly’s appointment of Michelle Bachelet to succeed him when his mandate comes to an end on 31 August 2018.

Wednesday the 5th Waning Moon of Āsāḷha B.E.2562, August 1, A.D.2018 Year of the DogLa France regrette que les élections législatives cambodgiennes se soient déroulées en l’absence du principal parti d’opposition (parti du salut national), dissous le 16 novembre 2017, tandis que son président, Kem Sokha, est incarcéré depuis le 3 septembre.

Ces élections se sont tenues dans un climat qui n’a pas permis à l’opposition, aux médias et à la société civile de fonctionner sans entrave.

Nous appelons à la libération de Kem Sokha et à la levée de l’interdiction faite à 118 membres du parti du salut national de mener pendant cinq ans des activités politiques.

Nous exhortons les autorités cambodgiennes à respecter les droits fondamentaux permettant de garantir un processus démocratique crédible.

Monday the 3rd Waning Moon of Āsāḷha B.E.2562, July 30, A.D.2018 Year of the DogThe United States regrets that Cambodia’s July 29 parliamentary elections were neither free nor fair and failed to represent the will of the Cambodian people. The flawed elections, which excluded the country’s principal opposition party, represent the most significant setback yet to the democratic system enshrined in Cambodia’s constitution, and substantially erode Cambodia’s achievements in promoting political reconciliation and economic growth since the 1991 Paris Peace Agreement.

We are profoundly disappointed in the government’s choice to disenfranchise millions of voters, who are rightly proud of their country’s development over the past 25 years. Genuine democracies tolerate opposing political views, foster competition through elections, and promote and protect the free exchange of ideas. In contrast, in the months leading up to the vote, the Cambodian government placed ever tighter restrictions on independent media and civil society, dissolved the main opposition party, jailed the opposition leader, and banned that party’s senior leaders from participating in the political process. The campaign was marred by threats from national and local leaders to punish those choosing not to vote. These actions denied the Cambodian people a voice and choice in determining the future of the country.

The United States will consider additional steps to respond to the elections and other recent setbacks to democracy and human rights in Cambodia, including a significant expansion of the visa restrictions announced on December 6, 2017. In the meantime, we call on the Cambodian government to take tangible actions to promote national reconciliation by allowing independent media and civil society organizations to fulfill their vital roles unhindered, immediately releasing Kem Sokha and other political prisoners, and ending the ban on the political opposition.

សហរដ្ឋអាមេរិកមានការសោកស្តាយដែលការបោះឆ្នោតសភានៅកម្ពុជា នៅថ្ងៃទី ២៩ ខែកក្កដា គ្មានភាពសេរី និងយុត្តិធម៌ ហើយមិនតំណាងឲ្យឆន្ទៈរបស់ប្រជាពលរដ្ឋកម្ពុជា។ ការបោះឆ្នោតដែលមានកំហុសឆ្គងនេះ ដែលបានផាត់ចេញនូវគណបក្សប្រឆាំងសំខាន់ជាងគេនៅកម្ពុជា គឺជាបរាជ័យមួយយ៉ាងធំបំផុតចំពោះប្រព័ន្ធប្រជាធិបតេយ្យ ដែលមានចែងនៅក្នុងរដ្ឋធមុ្មនុញ្ញនៃប្រទេសកម្ពុជា ហើយកាត់បន្ថយយ៉ាងច្រើននូវការសម្រេចបានរបស់ប្រទេសកម្ពុជា នៅក្នុងការជំរុញការផ្សះផ្សានយោបាយ និងកំណើនសេដ្ឋកិច្ច តាំងពីមានកិច្ចព្រមព្រៀងសន្តិភាពទីក្រុងប៉ារីស ឆ្នាំ១៩៩១ មក។

យើងមានការខកខិត្តយ៉ាងខ្លាំងដែលរដ្ឋាភិបាលកម្ពុជាសម្រេចដកសិទ្ធិបោះឆ្នោតពីអ្នកបោះឆ្នោតរាប់លាននាក់ ដែលមានមោទនភាពដោយត្រឹមត្រូវ ចំពោះការអភិវឌ្ឍន៍នៃប្រទេសរបស់គេ នៅក្នុងរយៈពេល ២៥ ឆ្នាំកន្លងមកនេះ។ លទ្ធិប្រជាធិបតេយ្យពិតប្រាកដមានការអត់ឱនចំពោះទស្សនៈនយោបាយប្រឆាំង ជំរុញការប្រកួតប្រជែងតាមរយៈការបោះឆ្នោត និងជំរុញហើយការពារការផ្លាស់ប្តូរមតិយោបល់ដោយសេរី។ ផ្ទុយទៅវិញ នៅក្នុងរយៈពេលប៉ុន្មានខែនៅមុនការបោះឆ្នោតនេះ រដ្ឋាភិបាលកម្ពុជាបានធ្វើការរឹតត្បិតកាន់តែខ្លាំង លើប្រព័ន្ធផ្សព្វផ្សាយឯករាជ្យ និងសង្គមក្រៅរដ្ឋាភិបាល រំលាយគណបក្សប្រឆាំងធំជាងគេ ចាប់មេដឹកនាំបក្សប្រឆាំងដាក់ពន្ធនាគារ និងបានដាក់បម្រាមលើមេដឹកនាំជាន់ខ្ពស់នៃគណបក្សនេះមិនឲ្យចូលរួមនៅក្នុងដំណើរការនយោបាយ។ យុទ្ធនាការបោះឆ្នោតត្រូវបានរារាំងដោយការគំរាមកំហែងរបស់អ្នកដឹកនាំថ្នាក់ជាតិ និងថ្នាក់មូលដ្ឋានថានឹងដាក់ទោសលើអ្នកដែលសម្រេចចិត្តមិនទៅបោះឆ្នោត។ ទង្វើទាំងនេះធ្វើឲ្យប្រជាពលរដ្ឋកម្ពុជាបាត់បង់សំឡេង និងសិទ្ធិជ្រើសរើស នៅក្នុងការកំណត់អនាគតនៃប្រទេសរបស់គេ។

សហរដ្ឋអាមេរិកនឹងពិចារណាលើជំហានបន្ថែមទៀត នៅក្នុងការឆ្លើយតបទៅនឹងការបោះឆ្នោតនេះ ហើយនិងដំណើរថយក្រោយដទៃទៀត នៅក្នុងពេលថ្មីៗនេះ នៃលទ្ធិប្រជាធិបតេយ្យ និងសិទ្ធិមនុស្ស នៅកម្ពុជា ដោយរួមមានការពង្រីកច្រើនថែមទៀតនូវការដាក់បម្រាមលើការផ្តល់ទិដ្ឋាការ ដែលត្រូវបានប្រកាសកាលពីថ្ងៃទី ៦ ខែធ្នូ ឆ្នាំ២០១៧។ ទន្ទឹមនឹងនេះ យើងសូមអំពាវនាវឲ្យរដ្ឋាភិបាលកម្ពុជាចាត់វិធានការច្បាស់លាស់ នៅក្នុងការជំរុញការផ្សះផ្សាជាតិ ដោយអនុញ្ញាតឲ្យប្រព័ន្ធផ្សព្វផ្សាយឯករាជ្យ និងអង្គការសង្គមមិនមែមរដ្ឋាភិបាលអាចបំពេញតួនាទីដ៏សំខាន់របស់គេ ដោយគ្មានការរារាំង ដោះលែងលោក កឹម សុខា និងអ្នកទោសនយោបាយដទៃទៀតជាបន្ទាន់ ហើយបញ្ចប់ការដាក់បម្រាមលើការប្រឆាំងផ្នែកនយោបាយ។

Cambodia: Before crucial vote on Sunday, UN chief calls for ‘pluralistic political process’

As Cambodians prepare to vote in general elections on Sunday, the United Nations Secretary-General issued a statement on Friday calling for “an inclusive and pluralistic political process” saying that it “remains essential for safeguarding the progress made by Cambodia in consolidating peace.”

Through his spokesperson, Stéphane Dujarric, he called on all political actors “to reduce tensions and political polarization.”

Prime Minister and leader of the Cambodian People’s Party, Hun Sen, has ruled the country for more than 30 years, and last November the rival Cambodia National Rescue Party was dissolved, by court edict, according to reports.

The UN independent expert appointed to monitor human rights in Cambodia, Rhona Smith, said at the end of April that there could be no “genuine” election process “if the main opposition party is barred from taking part.”

The UN chief on Friday called on the Cambodian government “to uphold international human rights standards and in particular to ensure guarantees for civil society actors and political parties to exercise their democratic rights.”

“He reiterates the continued commitment of the United Nations to support a peaceful and democratic Cambodia that fully respects the human rights of all its citizens,” concluded Mr. Dujarric.

Cambodia: EU mission assesses human rights and labour situation

A delegation of the European Commission and the European External Action Service (EEAS) visited Cambodia from 5 to 11 July 2018 to evaluate the situation on the ground following recent worrying human rights and labour rights developments in the country.

The European Union will now analyse as a matter of priority the information gathered during the mission to consider further steps. This analysis will also take into account further written submissions from the Cambodian authorities, reports of the International Labour Organisation (ILO) and other bodies responsible for monitoring the implementation by Cambodia of the international conventions relevant to the EU duty-free trade scheme Everything But Arms (EBA). The EBA trade scheme allows Cambodia to export all products (except arms and ammunition) into the EU, free of quotas and tariffs.

Commissioner for Trade Cecilia Malmström said: “The EU is proud to provide the most economically vulnerable countries of the world with free access to our market. The Everything But Arms initiative has had a significant impact on development and poverty eradication in Cambodia. Nevertheless, the recent worrying developments in the country have called for a closer assessment of whether Cambodia is fulfilling its commitments. The discussions and information gathering during our EU mission have focused on the serious decline in the area of political and electoral rights, as well as a curbing of civil society activities. There are also deficiencies when it comes to land dispute resolution mechanisms, and serious threats to freedom of association and collective bargaining rights. In the trade policy of the European Union, social justice is a vital aspect, including the respect for human rights, fundamental freedoms and labour standards. Following the fact-finding mission, we will now analyse the facts in detail, and consider further steps. Removing Cambodia from the trade scheme is a measure of last resort, if all our other efforts have failed to address these concerns.”

The EU delegation met with several members of the Cambodian government, as well as trade unions, civil society, businesses, and the United Nations (UN) and International Labour Organisation (ILO) representatives in the country.

Background

Under the EBA arrangement of the Generalised Scheme of Preferences the EU unilaterally grants exporters from the Least Developed Countries (LDCs) tariff-free and quota-free access to its market for all products (except arms and ammunition) with the aim to contribute to the economic development of these countries and their integration into the global trading system.

The EBA has brought important benefits to the Cambodian economy. The EU is the main export destination, accounting for 40% of Cambodia’s overall exports. Cambodian exports to the EU have risen sharply in recent years, increasing by 227% between 2011 and 2016. In 2017, Cambodia’s total exports to the EU reached €5 billion, placing it second amongst all EBA beneficiaries. Out of all of Cambodia’s EBA-eligible exports, 95.5% were made under EBA preferences.

EBA has contributed in particular to significant job creation and growth in the textile sector, which accounts for 75% of Cambodia’s exports to the EU, providing employment for some of the most vulnerable sectors of Cambodian society.

The EU has stepped up its engagement with Cambodia (see the EU biennial GSP report of January 2018) in response to serious concerns about the continuing deterioration of democracy, respect for human rights and the rule of law, as flagged also by the European Parliament (Resolution of 14 December 2017) and the Council (the EU Foreign Affairs Ministers’ Council of 26 February 2018).
